Ex-VBS chair lifts the lid on how Julius Malema and Floyd Shivambu grabbed R16.1m from dying bank

In early 2017 ‘at the EFF’s penthouse in Sandton’, the VBS-looter-in-chief Tshifhiwa Matodzi met Julius Malema, Floyd Shivambu and Marshall Dlamini — the result of that meeting culminated in R16.1m in stolen VBS funds as a ‘donation’ to the EFF. The ‘donation’ bought Malema and Shivambu a restaurant in Soweto, upgrades to Malema’s Sandton home, a house for Shivambu’s parents and payments towards their luxury lifestyle.

Former chairman of VBS Mutual Bank Tshifhiwa Matodzi, who this week was sentenced to an effective 15 years in jail for his coordinated looting of the bank, has lifted the veil from a seven-year-old secret: Julius Malema and Floyd Shivambu were “promised” payments from VBS in favour of the EFF.

Malema and Shivambu were allegedly paid off not to use the EFF’s political muscle against VBS Mutual Bank.

Matodzi pleaded guilty this week to 33 counts of corruption, theft, fraud, money laundering and a pattern of racketeering activities for which he was sentenced to an effective 15 years in jail. He entered a plea deal and signed a 70-page witness statement on 10 July 2024. 

The statement with annexures totals 263 pages and took around three weeks to draft, sources say.

 

It is notable from Matodzi’s account that Malema and Shivambu seemingly consistently used the EFF party as bargaining power, even going so far as to allegedly say that the restaurant in Soweto is “an EFF restaurant” where the facts show that Malema and Shivambu used almost all of the loot for their personal wealth and that the EFF gained very little from the unlawful arrangement and VBS-loot.

(Daily Maverick contacted Malema and Shivambu as well as EFF spokesperson Sinawo Tambo on their phones — without success. As this is a breaking news report, their comment will be added in due course.) 

Malema and Shivambu knew the funds they received from VBS were unlawful, Matodzi claims, because Malema and Shivambu created a front company called Sgameka Projects. There was no legitimate business reason for these payments — they told him they needed money for their restaurant in Soweto and, tellingly, they tried to “regularise” the payments after the curatorship of VBS by backdating a contract that was never entered into.

Sgameka Projects was an ostensible legitimate company managed by Floyd’s brother Brian Shivambu and “was provided to me by Floyd to make payments that I promised the EFF”, Matodzi wrote in his affidavit.

Zuma loan

Matodzi explained how it all came about. At the time, VBS Mutual Bank had granted former president Jacob Zuma a home loan for his Nkandla residence. This created a public storm and “negative publicity arose in the country. Particularly from those that were opposed to Zuma at the time.” 

The EFF was counted among the most vociferous critics of the VBS loan to Zuma, and Malema campaigned on stage against VBS at political rallies.

“As chairman of VBS, I then decided that Malema and EFF should be approached for VBS to explain its position and how the loan was granted.”

A meeting “with Julius at the EFF’s penthouse in Sandton around April/May 2017” was arranged. There is no deed document registered to the EFF that suggests the party owns a penthouse in Sandton, Daily Maverick can confirm. (Journalist Jacques Pauw did publish in his book Our Poisoned Land that Malema had access and at times full use of tobacco baron Adriano Mazzotti’s penthouse at the Raphael Penthouse Suites in Sandton.)

Nevertheless, Matodzi says that at the penthouse were Malema, Floyd Shivambu and Marshall Dlamini. “Dlamini did not participate in the meeting, and he was seated far from where the engagement took place”, Matodzi writes.

Matodzi’s version is that he explained to Malema and Shivambu that their political rallies were embarrassing and damaging to VBS and that “as black brothers, the EFF’s constituencies were VBS target market also”. 

Then Matodzi swung the vociferous VBS/Zuma critics in his favour: 

“I further informed them that VBS was willing to offer a donation to the EFF. I then proposed that VBS can donate R5-million immediately once a bank account has been opened at VBS and R1-million per month to the EFF. I also made it clear that the amount could only be deposited into a VBS account, and that EFF should therefore open a bank account with VBS.”

VBS bank account

Sgameka Projects’ sole bank account was registered with VBS Mutual Bank. From Daily Maverick’s investigation, it is clear that the company never traded and never received any other income except from various companies linked to VBS. 

After the penthouse meeting, “Floyd and I remained in contact”. 

Floyd Shivambu later contacted Matodzi to confirm that an account at VBS had been registered “in the name of a company called Sgameka”, Matodzi said.

“A transfer of R5-million as promised was made on my instructions from Malibongwe to Sgameka on 8 June 2017. Subsequent payments were made to Sgameka VBS account every month and were paid from Vele or any of Vele’s subsidiaries. (sic)”

Matodzi’s testimony further creates a problem for Malema and Shivambu in that he paints them not as unknowing and naive participants, but as people who made a concerted effort to plan how the money would be safeguarded from prying eyes in the EFF.  

According to Matodzi, Malema and Shivambu knew that the funds they received into their front company Sgameka Projects were not kosher: 

“Myself, Julius and Floyd understood that concept of donation to mean gratification hence Floyd and Julius did not provide me with EFF’s own banking details for these ‘donations’.”

Grand Azania restaurant

There were “further subsequent meetings … held between Julius, Floyd and myself”, Matodzi said, and a “notable” incident was when Malema and Shivambu “informed me that they needed funding to renovate an EFF restaurant called Grand Azania in Soweto”.

When Daily Maverick wrote the first article of the Shivambu’s receiving VBS loot in October 2018, the groundworks for the Grand Azania restaurant had already started. Our investigation has shown that VBS funds were funnelled through fronts towards the building works. “Grand Azania” became a problematic name, and Malema and Shivambu decided on Sud — a restaurant in the bustling Vilakazi street, just up the road from where former president Nelson Mandela lived in Soweto. 

Matodzi said he gave Malema and Shivambu the name of David Nthlokwe, a general manager at VBS, who would oversee a “loan”.

“This loan application was made through Sgameka and was approved although I do not know the amount.”

R4m business ‘loan’

Daily Maverick’s investigation has shown this was a R4-million business loan and it was never paid back. One of the methods in which VBS managers regularised bribes was to offer “loans” which would never be paid back. In this case, instalments on the R4-million “loan” were never made. 

Matodzi and other sources suggest that panic ensued when VBS was placed under curatorship in early March 2018 — also among the EFF leaders. The Reserve Bank was peeking over Matodzi’s shoulder and prying open the bank’s secrets, an act triggering several meetings between Matodzi and the brothers Shivambu, Floyd and Brian, at Floyd’s residence in Bryanston (the rent for which, Daily Maverick can confirm, was paid for in part with VBS loot).

“This was the first time I met Brian”, Matodzi stated. Brian Shivambu was in an invidious position where he was roped into a financial crime and when VBS Bank imploded, he became the face of the money channelled to his brother and Malema.

Further indicating knowledge of their misdeeds, Matodzi says he and Shivambu attempted to “regularise” the VBS loot unlawfully flowing to Sgameka Projects.

“At one of the meetings,” writes Matodzi, “myself, Floyd and Brian agreed to regularise the R5-million plus R1-million monthly donations. It was agreed amongst us that we draft a contract between Vele and Sgameka for consulting work in petroleum and storage facilities. The said contract which we backdated by agreement, was drafted by the Shivambu brothers”. DM

But once they get a taste of money and other 'gratifications' it all falls to pieces. @Ayanda Nonkwelo - everyone in civil and business society castigated Jooste when his crimes became evident and they applauded and supported all legal processes to bring him to book (and he committed suicide just as he was about to be arrested). Nobody tried to excuse his actions. Furthermore, Jooste was not a political leader pretending to advocate for the poor. Malema is a political leader that promises the poor he will look after them whilst stealing from them. Why can't the people he promises to serve (the same people from whom he steals) stand up and publicly advocate for his arrest (just like those people in business did when Jooste stole from them)?

Thanks to DM and Scorpio and all the investigative journalists. Thanks for bringing all this and more out. These guys work for very little at huge risk, for us, for South Africa and yet I am aware that many of my friends fail to support this effort. We really have to change this, please everyone appeal to your friends and challenge them to support if they don't already. It is essential for our country to put these crooks away and continue this work. I can see DM is already struggling for funds and between the lines one can see that are shocked at the lack of support from us. Can you spare 100 bucks a month? I am old and living off a pension but R100 goes to DM, and we owe them big I promise you.

Would you please publish an article on Jooste from Steinhof, who stole billions of dollars from PIC and German businesses as well? I don't remember DM publishing a story about the money laundering or informing us about it. R16 million stolen by the EFF compared to billions stolen by Jooste...PIC was impacted, but nobody voiced any complaints. While I do not support looting, I beg journalists to avoid being bias.

This modus operandi is vividly described by Tim Butcher in his book Blood River about the horror inflicted on citizens in the DRC by armed bandits. He describes the economy of “I make you trouble” which is employed by anyone who has either a uniform or a gun or both. Victims are then relieved of their money or possessions in exchange for the trouble to go away. In the same way, Malema and his bandits employ a strategy of making trouble for people and then extracting money from them to make the trouble go away. They use a political party as cover to legitimise the trouble. This is why they flip flop so easily. Once they’ve extracted their loot, they move to a different victim and as long as the payments continue, they will swing from “I make you trouble “ to “I protect you”. These bandits are a danger to society and unless they are brought to book, we will descend into the type of ongoing chaos of the DRC. Others will learn quickly how their money making scheme works and it will spread like wildfire. The fact that they stole from the poor women in his home base of Limpopo means there is no low to which they will stoop. As long as they can continue to afford their Gucci and champagne.

Before we all jump onto beating up the GNU, remember its up to the NPA and Police to action this intelligence, NOT the government. Thus far they have done very little - because they are still compromised by cadres. Clean up is taking much longer than anyone hoped, but we are seeing some glimmers of progress especially in the NPA, but its a mammoth task. And its really odd I am the one being positive for a change...

A few of Malema's notable financial contributions to South Africa over the years (I'm sure I'm missing a whole heap): * He and Floyd Shivambu bankrupted the ANC Youth League by losing a defamation case brought by Helen Zille for their tasteless and offensive remarks about her. * Malema had his farm (bought on a R20k a month salary) attached by the AFU for a R16 million tax bill - how do you rack up that kind of liability on that salary? * Malema's 'On Point Engineering' gets awarded roads contracts in his hood to the value of R52 million and delivers nothing at all (oh, I see, that answers the question above). * VBS - 'nuff said, although no doubt much more will emerge. * Malema's 'friendship' with a cigarette smuggler who gave him a free house to stay in. * The EFF splurged tens of thousands on renting a swish house from a German citizen for SONA 2019 and then spent a fortune on imported champagne and whisky - a middle finger to local workers. * Floyd and Malema are regularly shown wearing (once again) expensive, imported clothing and shoes giving another middle finger to local textile and clothing workers who they supposedly represent. * Expensive holidays in Mauritius, weddings at Ibiza (see 'friendship above), shopping sprees in Sandton City, membership of the Inanda Polo Club in Joburg - Malema's lifestyle is funded on the graves of the poorest and most vulnerable. Frankly, I'm not sure if he'll ever be brought to book properly, but I hope he is, and I hope he serves many, many years behind bars and everything he owns is taken away from him.

If he actually follows through and testifies I wouldn't put five bucks on him lasting 6 months. I very much doubt that he will though. Can't shake the feeling that the NPA's hopeless track record of prosecuting the nomenklatura isn't down to a lack of competent resources alone.

Sadly for the country, nothing will happen as the NPA are afraid of taking on "the rich and powerful", especially the top politicos. Yes arrests may well take place (to assuage public opinion), but then little will happen. All will be out on bail for the next twenty years or so.

Less than nothing will happen. They will sue everyone, tie up the courts,pull the race card, blame white owned media etc....It will take 5 years or more and theres a strong possibility that the NPA will bugger it up and they will both walk.

It's interesting to browse through the various news sites and see their take on this - News24, TimesLive and the Citizen all have it prominently featured, either as the lead article or one of the top articles, whilst IOL doesn't have anything on it at all! I even checked their Business section, given that, you know, fleecing banks would resonate with their proprietor, but nothing.

I'm not sure why we keep applying Western standards to the African people. They've made it consistently clear that they don't value concepts such as ethics, honesty, principles, scruples, etc etc. They want to do things the "African Way" where corruption and palm-greasing is the natural order. I just wish I didn't have to pay for their profligacy.

African/Black tribal mentality where the 'Big Chief' is king, and all the subjects must obey the Chief no matter what.... this has destroyed numerous African countries. Just like the weak 'sheep' like mentality of Whites in SA who supported the Apartheid government in the past were wrong. Both are/were weak. But people need to learn from their mistakes and grow and overcome. Most importantly, people need to stand up against their governments when their governments are clearly wrong.

Modus Operandi similar to what transpired in Steinhoff, but of course on a much smaller scale. *The question also to be asked why have African Bank to date not yet charged it's former CEO Leon Kerkinis and the Board of Directors for the Collapse of African Bank and the Billions lost by its Shareholders.* Similarly, why has Steinhoff not yet charged its Board for sleeping on the job, and in the interim at least compel to Repay the Remuneration that they received while serving as Directors and or Officers.

Are journalists now reporting the substance of convicted persons plea deals as fact. Haven't they learned anything from the internatuonal embarrasment the Shrien Dewani debacle brought the NPA a few years ago. This reeks of lawfare of the 'President and his men' to reckon with their political enemies. And without batting an eye the gullible scribes at DM are seemingly again the usefull or rather 'willfully use instruments' of a increasingly fascistic state apparatus. I fear the 'GNU' will the undoing of the SA democratic project in name of the public good. How come the banks never pick up on these fraudulent transactions ? When I received $ 1 000 from a friend in the US, I had a whole story from my bank, forms to complete, etc., on the pretext of preventing money laundering and fraud, and because it was an "unusual" transaction. These thugs shuffle millions with no investigation ? The banking industry stinks, as it always has.
