Trump administration to cancel student visas of pro-Palestinian protesters

WASHINGTON, Jan 29 (Reuters) - U.S. President Donald Trumpsigned an executive order on Wednesday to combat antisemitism and pledged to deport non-citizen college students and others who took part in pro-Palestinian protests.

  • Legal expert says order would be unconstitutional
  • Order vows immediate action by Justice Department
  • Trumps says US will deport 'pro-jihadist' protesters

By Andrea Shalal

A fact sheet on the order promises "immediate action" by the Justice Department to prosecute "terroristic threats, arson, vandalism and violence against American Jews" and marshal all federal resources to combat what it called "the explosion of antisemitism on our campuses and streets" since the Oct. 7, 2023, attack on Israel by Palestinian Islamist group Hamas.

"To all the resident aliens who joined in the pro-jihadist protests, we put you on notice: come 2025, we will find you, and we will deport you," Trump said in the fact sheet.

"I will also quickly cancel the student visas of all Hamas sympathizers on college campuses, which have been infested with radicalism like never before, the president said, echoing a 2024 campaign promise.

Rights groups and legal scholars said the new measure would violate constitutional free speech rights and would likely draw legal challenges.

"The First Amendment protects everyone in the United States, including foreign citizens studying at American universities," said Carrie DeCell, senior staff attorney at the Knight First Amendment Institute at Columbia University. "Deporting non-citizens on the basis of their political speech would be unconstitutional."

The Council on American-Islamic Relations, a large Muslim advocacy group, said it would consider challenging the order in court if Trump tried to implement it.

The Hamas attacks and the subsequent Israeli assault on the Palestinian coastal enclave of Gaza led to several months of pro-Palestinian protests that roiled U.S. college campuses. Civil rights groups documented a surge in hate crimes and incidents directed at Jews, Muslims, Arabs and other people of Middle Eastern descent.

The order requires agency and department leaders to provide the White House with recommendations within 60 days on all criminal and civil authorities that could be used to fight antisemitism, according to the fact sheet.

It calls for an inventory and analysis of all court cases involving K-12 schools, colleges and universities and alleged civil rights violations associated with pro-Palestinian campus protests, potentially leading to actions to remove "alien students and staff."

Many pro-Palestinian protesters denied supporting Hamas or engaging in antisemitic acts, saying they were demonstrating against Israel's military assault on Gaza, where health authorities say more than 47,000 people have been killed.

Maya Berry, executive director of the Arab American Institute, a nonpartisan civil rights group, said the group was deeply troubled by the apparent conflation of criticism of Israel with alleged antisemitism. Berry said the order would have a chilling effect on free speech across the U.S.

Those protestors covering their faces with kaffiyehs, disrupting classes, trashing campuses, burning flags and intimidating Jewish students are now crying because their actions have repercussions? Shame.

Mr. Fair Jan 30, 2025, 08:33 AM

Please share your source of telepathic ability. It is an amazing gift, to know the minds of so many people so far away, so you can confidently paint each one with the same accusation. Can you also tell if the pro-Israel protesters were all actually pro-apartheid, pro-genocide, pro-racism?

well said

Virtue signalling politics.

Rod MacLeod Jan 30, 2025, 08:32 AM

The Arab American Institute is a nonpartisan civil rights group? So, it looks after Japanese, Chinese, Russian, Ukrainian and Jewish folk too, then?

Mr. Fair Jan 30, 2025, 08:53 AM

There are many pro-Jewish only organisations, especially in the US. Are you saying that they cannot comment either if it were Jewish students being deported?

Jane Crankshaw Jan 30, 2025, 08:34 AM

Interesting fact….47000 Gaza deaths is less than 1% of the number of Jews killed by the Nazi regime! Not an excuse, all indiscriminate killing is bad no matter what, but the numbers of those killed is a lot less than expected when you see the destruction of the cities/ towns.

Mr. Fair Jan 30, 2025, 08:55 AM

I don't understand your point. Why compare the two? Have you compared the numbers as percentages of the total population? Or people killed per week? Why does it matter?

toAstY bo0rGir Jan 30, 2025, 10:06 AM

I agree this is a completely irrelevant and tone deaf statement

Hennie26 Jan 30, 2025, 09:37 AM

How many of those where Hamas operatives ?

Mr. Fair Jan 30, 2025, 03:04 PM

Nobody can say. Israel makes up their own statistics, Hamas only counts confirmed dead people (the UN has found their numbers to be reliable over the years), not their occupation. What we do know is that IDF have killed more women and children in Gaza than in any other conflict for 2 decades.

Hennie26 Jan 31, 2025, 04:23 PM

An estimated 650 000 civilians died in the Syrian Civil war that ended in 2021. And I would expect nothing other than that the UN would find Hamas figures reliable - given that they actually employ Hamas operatives.

Hilary Morris Jan 30, 2025, 08:55 AM

Ironic when the greatest threat to world stability spends his time signing orders that, often violate the US constitution. Please would someone lock this dangerous lunatic in a padded cell before he creates havoc that cannot be fixed. Not hate speech, just true despair!

Hennie26 Jan 30, 2025, 09:22 AM

If one has to pick a peak woke moment in history I am going to go with mid-October 2023 when people with pronouns in their names, people who hyperventilate at the sin of misgendering were calling for the death of Jews. I think that was when the penny dropped for many (otherwise) liberals.

Mr. Fair Jan 30, 2025, 09:37 AM

You have a very prejudiced inaccurate view of the conflict in Palestine/Israel. Please share all these occurrences of trans people calling for the death of Jews? I know there was, and is, a lot of unhappiness about the policies and actions of the Israeli government, which is not the same thing.

Hennie26 Jan 31, 2025, 04:16 PM

I don't normally take homework assignment demands from humongously disingenuous sources, and this page does not allow links. But all you need to do is to search for the terms of the Congressional hearing, "Antisemitism on College Campuses". Also read "Israelophobia" by Jake Wallis Simon.

gotta love a bit of fascism in our time

Ga g Jan 30, 2025, 10:44 AM

In China, foreigners cannot discuss let alone protest in support of a long list of items including: Taiwanese independence, Hong Kong pro-democracy, Xinjiang human rights abuses, Tibet human rights abuses, Winnie the Pooh (yes banned in China)..... I dont see anyone getting upset about this

Mr. Fair Jan 30, 2025, 11:26 AM

Ok then. Here I am, upset about that. It's not right at all. Happy? Now, let's talk about how China's government's policies on this topic affect the impunity of killing of tens of thousands of women and children in a year.

Lawrence King Jan 30, 2025, 11:14 AM

On October 8th they supported Palestine (why?), then called for ceasefire (done!) and now for liberation from the river to the sea - we know what that implies! Yet they ignore Israeli victims, and are blind to the brutality of Hamas. Yes, Palestinians need better - but Jew hatred doesn't help.

Mr. Fair Jan 30, 2025, 01:29 PM

The saying is "From the river to the sea, Palestine will be free". Get over the Jew-hatred excuse for the resistance to Israel's stealing of Palestine, treating the indigenous people like animals, & maintaining a violent, racist, apartheid state in it's place, based on words 1000s of years old.

Mr. Fair Jan 30, 2025, 01:44 PM

“Why?” The Nakba, the oppression, blockade, murder, detaining of Palestinians (often without charge, incl minors), land-grabs, the fact that Gaza is an occupied territory, not a sovereign enemy state, that Israel is for Jewish people only (apartheid), & all the others reasons for the resistance?

Hennie26 Jan 31, 2025, 04:30 PM

Israel left Gaza in 2006. It is not occupied. After they left, the first thing Hamas did was to destroy the hydroponic farms Israle left intact. The second thing they did was to turn Gaza into the biggest terrorist camp in history. It could have been so different, but Jew hatred won.

faithd Jan 30, 2025, 11:48 AM

He is clearly a dictator!

Marc Caldwell Jan 30, 2025, 01:24 PM

I suspect this order looks to the future. There's a game plan here. Even if the order is not applied, it actually discourages any future protests. Campus protests were part of Hamas strategy. Similarly, withdrawing funds from the UN makes rebuilding Gaza much more difficult.

Bendeta Gordon Jan 30, 2025, 03:35 PM

Whatever you feel about Trump, he doesn't mince his words or his decisions. Great leaders know their values & what they will & will not tolerate. He is not a politician. Thank G-d he is not a politician because politicians say what their electorate want to hear. Tump is concise. Thank G-d.

Mr. Fair Jan 30, 2025, 05:25 PM

Things his voters wanted: Better cost of living. Things he's done so far: Freed criminals, got a lot of non-whites fired from their jobs, removed aid for many people across the world... "Great leader"?

Hennie26 Jan 31, 2025, 04:34 PM

He shut down the non-productive DEI industry in one fell swoop, and the US private sector is following that move vigorously. Most of these DEI officials are whites that were indoctrinated in a a belief system that now has zero market value. DEI came from from the US, and it died in the US.

Mr. Fair Jan 31, 2025, 09:35 AM

He makes things up all the time to play politics. He blamed the Biden administration for the stranded astronauts on the ISS (Boeing's fault), & said he just called Musk to bring them home (Musk had already agreed last year, under Biden, & his modifying a craft to do it has delayed their return).

Mr. Fair Jan 31, 2025, 09:45 AM

He is racist. He blamed diversity programs for the aircraft crash. His immigration ideas, his white-first ideas, all panders to the racists who want to make the world "great" (back to "good" old days, where white people had privileged lives). It helps support for Israel, & power in oil areas.

Mr. Fair Jan 31, 2025, 09:49 AM

Want to revise your statement "he is not a politician because politicians say what their electorate want to hear"?
