SABC to investigate employee accused of abuse and racism aboard FlySafair flight

FlySafair has banned an SABC employee after she was filmed making racist remarks while disrupting a flight. Criminal charges against her have been withdrawn pending further investigation. The Patriotic Alliance says it will complain to the SA Human Rights Commission.

The Democratic Alliance (DA) and Patriotic Alliance (PA) have condemned the actions of a woman who was filmed making racist comments and being disruptive on a flight on 26 December.

Police have confirmed the woman was arrested and charged in terms of the  Civil Aviation Act No 13 of 2009 for disruptive and riotous behaviour on board an aircraft in service.

South African Police Service (SAPS) spokesperson Brigadier Athlenda Mathe told Daily Maverick on Sunday that the case had been presented to a prosecutor on 27 December for a first appearance. The case, she said, was temporarily withdrawn “pending further investigation and additional charges”.

Mathe said, “The captain of the aircraft indicated that the female passenger, who was highly inebriated, displayed disruptive and riotous behaviour while the aircraft was in service (airborne) and demanded to be served with alcohol.

“The passenger was positively identified by the captain. During police intervention, the passenger continued to display riotous behaviour by insulting SAPS members and threatened to sue them.”

A video of the woman — identified as 43-year-old Nobuntu Mkhize — went viral on social media after she was recorded on a FlySafair flight from Durban to Cape Town making racist comments towards a flight attendant. She was also filmed being disruptive.

On a video, she was heard saying: “You’re a coloured from Mitchells Plain, all these gold rings but no degree. Right now when we land, I’m going to take an Uber home. You don’t even have a [driving] licence. You don’t even have a car.”

Her comments have been widely condemned. Her employer, the SABC, said it would use “relevant channels” and initiate internal procedures against her.

Daily Maverick attempted to reach Mkhize via telephone and SMS but she had not responded by the time of publication.

She did, however, tell News24 that she was not drunk during the flight. She claimed she was discriminated against and planned to sue the airline and the police.

PA heads to SAHRC

On Sunday, Kenny Kunene, the deputy president of the PA — a party with large support from coloured communities — said: “The offensive statements targeting members of the coloured community and her other disparaging remarks undermine the spirit of unity, dignity and respect that our Constitution seeks to uphold.

“Racism, irrespective of its source, has no place in South Africa. As a nation that has endured the scars of racial injustice, we must remain vigilant in rejecting all forms of discrimination. No individual, regardless of their position or background, is above the law.”

Kunene said the party would lodge a complaint with the South African Human Rights Commission (SAHRC). The party also urged the SABC to “take firm and decisive action to address this incident”.

The DA’s Western Cape leader, Tertuis Simmers, said the party “strongly condemns the alleged racist incident that recently took place on a local FlySafair flight. This sort of discrimination has absolutely no place in our democratic society.”

Simmers plans to lay a charge of crimen injuria at the Bishop Lavis Police Station in Cape Town on Monday.

SABC: We’ll engage

The SABC said on Saturday it noted “with concern” the video circulating on social media.

“The SABC regrets this incident and always encourages staff members to uphold the SABC values of respect and integrity in all their interactions. In the video clip, this staff member mentions the SABC and states that this incident will be broadcast on SABC News,” read a statement issued by the public broadcaster.

“We would like to reiterate that SABC News is guided by the editorial code and maintains its editorial independence, and the decisions pertaining to all news items are made in the newsroom and not influenced by non-editorial staff members.”

The broadcaster said it would use “relevant channels in line with its internal procedures to engage the staff member”.

Meanwhile, Kirby Gordon, the chief marketing officer at FlySafair, told Daily Maverick that “this passenger will be placed on our no-fly list and will not be welcome on future FlySafair flights”.

The airline condemned her behaviour.

“Flight attendants have a primary duty as safety officers and interfering with their duties is a criminal offence.”

‘ANC bitch’

In the clips, Mkhize is heard saying that she was an “ANC bitch”.

ANC spokesperson Mahlengi Bhengu-Motsiri said the party noted the woman’s behaviour with “disgust and disdain”.

“The ANC categorically distances itself from such behaviour, which is contrary to the values and principles of our movement. Regardless of whether this individual is a member of the ANC, we unequivocally state that no person has the right to behave in such an unacceptable manner, and certainly not while misusing the good name of the ANC,” she said.

The party has initiated an investigation to determine her membership.

“However, even if it is confirmed that she is a member, her conduct is inexcusable and deeply embarrassing. The ANC will not allow its name to be dragged through the mud by individuals who fail to uphold the dignity and decorum expected of all South Africans, let alone members of our organisation,” said Bhengu-Motsiri. Is it an offence to be a little intoxicated on a plane? What are the allowable blood alcohol levels when flying? Strange as one is incentivised to consume alcohol while flying. Not surprising then someone gets unhinged every once in a while.

Steve M 30 December 2024 07:00 AM

Bob D, where is one incentivised to drink alcohol on an aircraft? The fact you can buy and are offered alcohol is not the same as been encouraged to drink

Bob 30 December 2024 07:37 AM

In my experience flying while drunk is virtually a national sport. Probably something to do with the hightened anxiety and stress levels associated with it. Perhaps the lady needs councelling, this was clearly a call for help.

MaverickMe 30 December 2024 12:57 PM

Flying while drunk is as clever as a sunroof in a submarine. Exactly how do you think a drunk person is going to react in an emergency situation? Sadly airlines put profit before sensibility.

Ritey roo roo 30 December 2024 01:28 PM

What??? Seriously, are you drunk now?

janetteklein.za 30 December 2024 02:34 PM

Oh, please !!! call for help? She is an abusive drunk. Full stop ! She must be punished for endangering the lives of the people on board.

louise.roderick 30 December 2024 11:06 PM

A cry for help? Are you crazy? This was unruly behaviour by an entitled person who cannot control her liquor consumption. She needs to do some self introspection.

d***e@g***.com 30 December 2024 07:03 AM

No one is "incentivised" to consume alcohol on flights. If anything Safair disincentivises drinking on flights with their pricing. She made a choice to drink heavily before the flight and assaulted the hostie when she was refused liquor. It then escalated and now she must face the consequences.

Gavin Hillyard 30 December 2024 07:25 AM

You are missing the point Bob. Disruptive behaviour on a flight is illegal and could put the flight in danger let alone the unpleasantness for the other passengers. There is no “incentive” for passengers to consume alcohol. It is available for responsible consumption.

virginia crawford 30 December 2024 07:51 AM

Drunk and disorderly is a criminal offence in most countries.

V***z@y***.com 30 December 2024 08:21 AM

Bob! Please stop smoking your weetbix so early in the morning!

Bob 30 December 2024 08:39 AM

No it's not an offence to be intoxicated on a plane, and nobody is saying it is. What is an offence is when you engage in aggressive behaviour towards crew or passengers, whether drunk or not. That is the offence here.

johnbpatson 30 December 2024 10:52 AM

Under international law it is an offence to be intoxicated on a plane -- courts usually go with drink drive limits when cases reach them. Main reason is that you have to be able to follow instructions and get out quick if ordered to do so by cabin crew. The law is often ignored...

Spot on!

Civil Aviation Act 2009 -"It is a crime to: commit any nuisance, or disorderly or indecent act; be in a state of intoxication" - see sections Section 135(a) and Section 135(b) of the Civil aviation act. seems like she's guilty of both.

Richard Blake 30 December 2024 01:36 PM

Listen to yourself. Anyone bought up with decency and respect would know that this behaviour is unacceptable regardless of whether you are drunk or unhinged. It is only in the ANC where such behaviour is considered acceptable along with rape, murder, and looting.

abrietraut 30 December 2024 06:37 AM

If she was not drunk she was cognizant of her actions and should be held responsible. If she was drunk that's 'just' drunk and disorderly behaviour... But probably tells you who she really is too.

r***e@g***.com 30 December 2024 06:38 AM

Lol, thank god i dont have her face. No wonder she is so upset

s***r@g***.com 31 December 2024 10:45 PM

Irrelevant

r***e@g***.com 30 December 2024 06:39 AM

Lol, black south africans always complain about racism, but they are by for the biggest racists in this country.

V***z@y***.com 30 December 2024 08:18 AM

Definitely agree with you!

V***z@y***.com 30 December 2024 08:18 AM

Definitely agree with you!

Jubilee 1516 30 December 2024 09:05 AM

True. Remember when those lowlifes swore at each other in the Maselspoort resort swimming pool, Cyril made a speech on racism in parliament. But when a pack of black men attack a white owner of a resort with knives and almost kill him. Deathly silence. Imagine reversing those race rolls. The outcry!

Trenton Carr 30 December 2024 06:42 AM

I lost it at, "the good name of the anc*, very funny, got a good snort out of me, Mahlengi. Don't think she knows what that means.

Jane Crankshaw 30 December 2024 06:45 AM

One has to hope this passenger doesn't live in Cape Town and was only visiting for a short while lol! Send her back to Zululand where she belongs!

Leon Torres 30 December 2024 12:11 PM

Spot on Jane! Let's combat racism with more racism! *In case this is not clear, which in this forum it never is, my statement is sarcastic*

Grumpy Old Man 30 December 2024 06:58 AM

This is a story - with pictures - of a life in absolute free-fall!

Granville Beck 30 December 2024 07:32 AM

She's just another arrogant racist thug, that comes in all shapes, colours and form. She forgets that our coloured brothers and sisters stood side by side with our black brothers and sisters during the struggle with great lossess on both sides. She spits at this legacy...know our history...

Grumpy Old Man 30 December 2024 07:57 AM

I am cognizant of our history (indeed who her Father was) and nor do I excuse her unruly behavior and racist utterances. For these, she needs to face the consequences of her actions. My comment is with respect to someone's general mental wellbeing

virginia crawford 30 December 2024 07:50 AM

Ho ho ho! In vino veritas: the ugly truth is told. Who is her father? Do tell. Why have charges been withdrawn, what investigating is needed. Anyway, she should be fired for bringing her employer into disrepute. Loved the way passengers joined in - only in S.A.

johnbpatson 30 December 2024 11:01 AM

The lady in the black and white dress was lucky she was not bitten. Never a good idea to put an arm near the mouth of an angry drunk.

tshiggo 30 December 2024 08:04 AM

What is the role of the SABC Brand Manager ... The only branding I'm aware of is that of a bankrupted, broken SOE. Suspect it's quite a stressful job ?

You Can Not Be Serious! 30 December 2024 09:14 AM

Charges withdrawn, political interference already. She should be fired from the SABC.

Gareth Dawson 30 December 2024 09:53 AM

The charges against the individual have not been withdrawn permanently; the key aspect of the withdrawal is that it allows for “further investigation” and the possibility of “additional charges.”

Martin Neethling 30 December 2024 10:35 AM

We’ll see Gareth. This is a massive test for the Human Rights Commission, the SABC, the ANC and the Rule of Law. All lekker and video’d but sadly not neatly part of the general narrative. She’s already armoured up - denying being boozed, claiming unfair treatment, bla bla.

Malcolm McManus 30 December 2024 11:06 AM

A massive test indeed. If her name was Penny Sparrow, she would be crucified. Interesting to watch this space.

Middle aged Mike 30 December 2024 10:35 AM

Those are the words they used. They may or may not reflect why and and at who's direction. My spidey sense says that she's being protected due to her connection to the glorious liberation movement and that SAPS, the NPA and the SAHRC will pull out all the stops to make her problems go away.

Confucious Says 30 December 2024 10:29 AM

She should be charged under the CAA for assaulting a flight attendant and endangering the crew and passengers!

Paul T 30 December 2024 10:55 AM

Buka Mina! Money can't buy you class.

Malcolm McManus 30 December 2024 12:35 PM

Waiting for the EFF to comment and mass protest.

Contrarian Guy 30 December 2024 01:28 PM

Imbecile. She will probably get a promotion in the cANCerous SABC...

Richard Blake 30 December 2024 01:31 PM

Another ANC brat behaving as they like because they have been told that they are entitled.

Fanie Rajesh 30 December 2024 02:10 PM

We need to stop fixating on racism. Until we do, it will fester. When people are under the influence, they say stupid things: could target race, ugly, stupid, short, skinny, fat, poor, old.... they're all the same. If the lady was disorderly she should be dealt with accordingly.

Contrarian Guy 30 December 2024 03:16 PM

Except when white people are accused Fanie?

Fanie Rajesh 31 December 2024 07:42 AM

My comment relates to all our people equally.

a***y@i***.com 30 December 2024 05:00 PM

Should have been handcuffed, restrained and taken into custody upon landing.

surveyorwouter 30 December 2024 02:21 PM

To the flight attendants congratulations on how you handled the situation. Good job guys!

Sello 30 December 2024 04:04 PM

All parties that are interested in this matter must show cool heads to prevail before taking any drastic steps. This matter requires thorough investigation with no predijuce and remedy the situation accordingly with no political connotations.

Fanie Rajesh 31 December 2024 07:49 AM

She is a person who must simply face the applicable laws. Cool heads are not relevant here.

Mike Pragmatist 30 December 2024 06:58 PM

Her only correct action was in the accuracy of her self-description.

Lian 31 December 2024 11:55 AM

Do you expect any action from a govertnment that is soft on corruption ?
