Karoo councillor fined once more — for repainting pedestrian crossing and parking spaces at church

A councillor from Aberdeen in the Eastern Cape has again been fined R350 after he repainted the pedestrian crossing and parking spaces at the NG Church in town. He was summonsed in a similar case a few weeks ago, but this was thrown out of court.

‘Look, actually, my paint is finished so I was just relaxing at home,” Councillor Eldridge Ruiters from Aberdeen said on Tuesday afternoon after he was fined again for repainting parking spots and a pedestrian crossing at the Aberdeen NG Church.

“Next thing I know the police arrive here, at my house, with the municipal law enforcement to give me another summons. The policeman said next time they are also going to open a docket,” Ruiters said.

“That is the last project we did. The paint is finished now,” he said.

He still has no intention to pay the fine – “I will go to court again.” 

He has been fined for painting without authorisation or without obtaining permission.

On 4 November, Ruiters was summoned to appear in court with the option of paying a fine for repainting road markings in Aberdeen, including the parking spots at the court. The case, however, was thrown out by the prosecutor as nobody could find the by-law that the municipality alleged he had contravened – even after the prosecutor phoned the Dr Beyers Naude Local Municipality.

But now he has been furnished with a typed page containing by-law 16. It does not appear to be from the government gazette. This by-law states: “No person other than an authorised official of the municipality in the performance of his or her duties may apply, mark, paint, or draw lines, marks, words, signs or advertisements on the surface of a street or public place.”

Ruiters said he had served as a Democratic Alliance member of the council since 2013 and could not recall seeing this by-law or adopting it in council.

He said he always measured and made sure that the lines he painted were in accordance with road traffic regulations. 

The wording in the by-law appears to be the same as that of a by-law passed in Kouga Municipality on 27 December 2006. Both are marked 16(6). The gazetted version of the Dr Beyers Naude Local Municipality by-law, however, could not be found on either the municipal website, in the government gazette or on request to two municipal officials.

Previously, Eastern Cape spokesperson for the National Prosecuting Authority Luxolo Tyali said the repainting was not a trivial matter.

“That is a very serious offence. If people change road markings, others might follow those and get into serious accidents. Road signs and markings have to comply with the law. Making your own markings or changing markings is changing legal directives to suit you,” said Tyali.

“If we leave him, others may follow suit, and that may lead to anarchy,” he said.

What an idiotic case! Pursue those incompetent or lazy councilors who are not applying themselves for 'the people' to do what they are supposed to do. Managing a municipality is more than just 'selecting your next fancy vehicle'!

The municipal official responsible for the upkeep of the roads should be charged with derelict of his or her duties instead of the councilor being charged. Precisely this attitude discourages citizens from wanting to make a difference in their community.

Refreshing a pedestrian crossing would not constitute the painting of a line, word, sign or advertisement. The question therefore resolves into whether it could constitute painting a "mark" - not a road marking. No marks for the council, though.

Aberdeen's road markings are repainted annually, the roads retarred every two years and pavements neatly maintained. Street and traffic lights are all functional. Oh wait. I'm thinking about the Aberdeen in Scotland.

You're spot on about the security companies. Some Joburg residents even have private fire-fighting services linked to their security companies... that is how useless the Joburg municipality is. (I am one of those residents with a private fire service.)

This emanates from the Mad Hatter's tea party. The summons' validity is questionable since there are alterations indicating that whoever completed it is elsewhere in time or is incompetent. Leave aside the waste of resources. Three police officers and two vehicles to issue a summons. Insane!

In doing a fantastically good deed, Mr. Ruiters has unfortunately given his detractors just the reason they looking for to justify their actions - pedestrian crossings are painted white not yellow.

The bottom line is that this demonstrates that municipal management is failing to do its job ie. maintain the towns infrastructure. They are the ones that should be held accountable (to rate payers), charged and then fired.

If he changed road markings (colour, shape, words) - fair enough. If he simply added paint to the same place where paint had been applied and the markings effectively changed nothing except for better visibility, I don't see the problem. Personally, I would have asked for written permission - etc.

Cadre excellence at its very finest. The accused should go open a criminal case at the SAPS against the responsible salary-grabbing cadres at the council, for recklessly endangering the safety of road users by gross dereliction of their duties.

Where I live we (residents) have repainted all the kerbs at street corners and the street names thereon. This has caused us no problems. But we are advised (by DA councillors) not to retouch actual road markings or otherwise paint on the roads. This comes down to issues of legal culpability.

The by-law in question is the Camdeboo Municipality Roads and Traffic By-law, published in EC Provincial Gazette No. 1634 on 11 December 2006. Camdeboo Municipality was a predecessor of Dr Beyers Naudé municipality. It is uncommonly silly to bother to enforce it in this case though.

If the municipality applied the same fervor to maintaining the road markings, as is required of them, rather than harass someone who cares and is prepared, at no cost to the town, to keep the road markings painted and clear, then I could understand their action. Maybe if he was not a DA member?

Absolutely and the ANC, SAPS and the NPA couldn't possibly orchestrate their responses any better to cast shade on themselves and sunshine on the DA. Sadly the quality of electoral decision making in SA is so poor that it probably won't have any beneficial effect.

Will a paint company please donate as much road marking paint to the gentleman in question so that he can continue with his good work. He can marshal as many like minded residents in joining him one Saturday to complete the job. The council needs to be grateful not vindictive

SA "law enforcement" - the appointment of completely UESELESS &amp; INCOMPETENT OFFICIALS. They are clueless as to doing real work; so 'pick' on someone doing good. Look at the pic - how many vehicles do you need for ONE person? Call for murder etc...the reply: "sorry, no vehicles available"
