Municipal councillor summonsed to appear in court for repainting faded road markings in Karoo town

A DA councillor and lifelong resident of Aberdeen in the Karoo Eldridge Ruiters had to appear in court on Tuesday after the municipality notified him that he was painting lines on the road without permission.

Aberdeen resident and DA councillor Eldridge Ruiters had to appear in the town’s magistrates’ court on Tuesday, 5 November 2024, after he received a notice that he was painting lines on the town’s roads “without permission”.

Ruiters has admitted that he was repainting the lines in the town as the faded road lines and parking spot indicators have not been painted in many years, and are faded and barely visible.

While several other municipalities in the country have bylaws that prohibit the painting of road markings without the municipality’s permission, it is not evident that the Dr Beyers Naudé Local Municipality has such a bylaw. The municipality did not respond to a request for comment.

Eastern Cape spokesperson for the National Prosecuting Authority Luxolo Tyali said it wasn’t a trivial matter.

“That is a very serious offence. If people change road markings, others might follow those and get into serious accidents. Road signs and markings have to comply with the law. Making your own markings or changing markings is changing legal directives to suit you,” said Tyali.

“If we leave him, others may follow suit, and that may lead to anarchy,” he said.

Ruiters, however, was adamant that he was not doing anything wrong. “I measure and do it strictly according to the bylaws,” he said.

“I won’t lie, we want the votes, that is why we have started this campaign. The DA bought the paint,” he said.

“But I am not doing anything wrong. Where the lines are faded, I paint exactly over the same lines and, where you can’t see the lines, I look up what the measurements must be, and we measure and paint exactly according to these.”

Ruiters is a PR councillor in the municipality’s council. The two ward councillors in Aberdeen, however, are from the ANC.

To his surprise, Ruiters was first tipped off by a resident while he was on his way to Graaff-Reinet that trouble was coming. The next thing he knew, at 9am on Friday he received a notice to either pay a R350 fine or appear in court. 

He chose court. 

“I was preparing for court the whole weekend. I was looking for that bylaw, but I couldn’t find it. Also, they gave me a traffic notice. He said the ‘onder-magistraat’ [the colloquial word for the prosecutor] told him she could also not find the bylaw and even phoned the municipality for clarity but could not find anything. So, she refused to put the case on the court roll.

“I must go to court tomorrow to go fetch my proof that the case was removed,” he said. 

He said there were a lot of private initiatives to clean up and restore Aberdeen. 

“I really feel like this was a malicious prosecution,” he said. “What a chance to take with me … they don’t even have a bylaw like that.” DM

Another case of someone having not done their job, or a result of corruption. For god sake, faded traffic lines are equally dangerous and can also cause serious accidents. Just another exercise to try and save face after a council being exposed for being completely useless.

Oh really, he was just joking about that. The man is a hero for actually getting off his backside and doing something. He may even have saved someone's life through his actions unlike the utterly useless and presumably corrupt ANC idiots.

So, this is 'a serious offense' for the NPA. Why not prosecute people filling potholes too? On the other hand, would it not be better to apply your NPA minds to corruption in the municipalities, so that they use the rates money to provide the services to keep the road markings safe and legal?

Yes. I loved that part too. This guy, Luxolo Tyali , is just doing what they all do: jerking his knee because that is what an ANC spokesperson does. He did not even know Ruyters was overpainting existing lines.

Instead of wasting tax payers money on vanity projects and especially on diverting the funds away from what they are supposed to be used for, municipalities should be finding ways to get things done properly using ANY expertise. How difficult can it be to organise a self help group?

As the NPA do not have the competency (or will) to handle more complex matters, e.g. the state capture artists, the ANC politicians' corruption cases, etc., they must find something to justify their existence. However, painting white lines in a remote dorpie falls within their limited capabilities.

It's a constant source of amusement to me that so many amongst us think the role of the NPA is to prosecute without fear or favour. That view is typically held by the same people who mistake SAPS for a law enforcement agency and Ramaphosa for someone who is opposed to graft and corruption.

He should have known better. Where I live the councillors advised that we do not remark roads without getting consent, because of the possible consequences in law. BUT there is a vacuum left in many towns because council doesn't get anything done. So residents want to fill that void where they can.

'Vaccuum' is generous. It's a 30 year old black hole of looting. The councillor knew exactly what he was doing. Asking permission to do what you pay the thieves handsomely for not doing is playing in their panto. Upside is that it showed them and the NPA up and gave the DA some positive press.

There are ways to deal with these situations. EG the very succesful Tidy Towns project on the KZN South coast. I understand the frustration, but acting uniltaterally is usually not a good idea.

It's possible that the markings were painted correctly, or at least such that they could be useful still even if not done accurately. But when there aren't any markings or same are not visible, I would submit that's a much woree scenario.

This case again shows that members of the cANCer party can get things done when they really want to. Its just sad that they are happy to do nothing almost all of the time and will then spring into action when they are being shown up (and are happy to spend ratepayers money to do so). Pathetic!
